This agreement is a Contract for a short-term holiday rental between the Owners (referred to as “us” or “we”) and the person making the booking and all members of the holiday party (referred to as “you”, “your”, “guests” “clients”) under the following booking conditions.
The person whose name is on the booking form (referred to as the “Responsible Person”) agrees to take full responsibility for ensuring that all Terms and Conditions herein are adhered to by all members of the party.
The Responsible Person is liable for the booking, must personally stay at the accommodation throughout the holiday and be at least 18 years of age at the time of booking. The names and ages of all members of the party must be shared with the owners if requested.
When you submit a booking request via the online system you may receive an automatically generated booking summary by email but this does not form a contract between us. A contract shall only arise when your booking is subsequently completed by the direct exchange of a “CONFIRMATION” email from the owner to you.
The property shall be used for holiday purposes only and must not be sub-let.
Scottish law will govern the Booking Contract. The booking agreement confers the right to occupy the accommodation for the agreed period only. You undertake to use the property solely for its purpose as self-catering accommodation and to accept the Owner’s right to refuse access to the accommodation to any person, whether the Responsible Person or guest of the Responsible Person, deemed unsuitable. Causing a nuisance or disturbance to neighbours or any unreasonable behaviour may result in the Owner requiring the Responsible Person or their guests to leave the property.
The number of persons occupying a property must not exceed the maximum number stipulated and agreed on at the time of booking. We reserve the right to terminate the hire without notice if this condition is breached. Children over the age of 2, not sleeping in a travel cot, count towards the total number of guests. Guests are welcome to visit but must not stay overnight.
We do not allow “hen” or “stag” groups as our holiday home is primarily for family holidays and designed to ensure that all of our guests enjoy their holiday in our property. Please note that we reserve the right to refuse a booking at our sole discretion where necessary.
3. Prices and Payment Terms
All prices include VAT at the current rate, and water and electricity charges. Prices may change to reflect any increases in VAT or other statutorily imposed charges. All prices are subject to change depending on market conditions and may increase or decrease. However, the holiday price confirmed at the time of booking will be the final price you pay and will not change, unless you make a change to your booking.
A non-returnable deposit of £100.00 is payable on booking.
The balance of the rental is payable six weeks (42 days) prior to arrival. For bookings made less than six weeks in advance, the total amount is payable at the time of booking.
You are responsible for the cost of any bank charges payable if the funds are transferred from abroad. If there is any shortfall in the total due and the amount paid this must be paid in full prior to your arrival.
In the event of the failure to submit the balance six weeks prior to the date of commencement of your holiday we reserve the right to re-let the holiday home and you shall have no further claim against the owner.
No entry to the property will be allowed without payment, in full, being cleared beforehand. Once you have a confirmed booking (i.e. the deposit has been paid and processed), you are responsible for the full rental cost even if you subsequently cancel.
4. Alteration or Cancellation by you
Once there is a confirmed booking you cannot transfer your booking to anyone else or change it without our consent. Any agreed changes to your booking may incur additional charges depending on the type of alteration but in all cases an administration fee of £25.00 will be applicable.
You may cancel your holiday in full at no charge within 24 hours of receiving your booking confirmation email.
Thereafter you may cancel at any time but you may incur charges. Your “Cancellation Notice” will take effect on the date it is received by us in writing via email. We will confirm your cancellation by replying to your email.
Any refunds due will apply to the number of day’s notice you give before the holiday start date.
Cancellation costs are as follows:
• More than 42 days notice - Loss of £100.00 deposit.
• Between 29 – 41 days inclusive, 60% refund of total holiday rental.
• Between 15 – 28 days inclusive, 40% refund of total holiday rental.
• Less than 14 days – NO REFUND.
CANCELLATION INSURANCE: Cancellation insurance is not compulsory and we do not provide any to you but we strongly recommend you ensure you have adequate holiday insurance in place to cover this holiday let and that your policy terms provide sufficient cover to protect you against the cancellation penalty above.
5. Alteration or Cancellation by us
If for any reason we have to cancel your booking in advance due to circumstances beyond our control for example fire, flood, exceptional weather conditions, epidemics, destruction/damage to the property (“force majeure“) etc, you will be refunded the full amount of the booking.
If we have to terminate your holiday early for the above reasons you will be refunded part of the booking fee based on the time remaining of the booking. This will be the full extent of the liability of the Owners. No additional compensation, expenses or costs will be payable.
Your accommodation will be available from 3pm on the day of your arrival. Details about key access can be found on your Booking Confirmation Email.
We can arrange for an earlier check-in but this cannot be guaranteed due to time required to prepare and clean after other previous guests have vacated. For this reason early check in will incur an additional charge for priority cleaning etc.
Linen, duvets and pillows are provided (except for cots).
If you have not hired towels you will need to bring your own.
You should vacate your holiday home by 10am on your departure date at the end of your holiday and return your key(s) to the owner or per any alternative agreements made at the time of your booking.
On departure, you are requested to leave the accommodation in a clean and tidy condition. This includes washing up, emptying as appropriate all cupboards and fridge/freezer, putting all rubbish in appropriate outside bins, ensuring cooker hob and ovens are clean and free from grease and beds, which have been used, stripped if at all possible. We reserve the right to make a charge of £75 for any extra cleaning if the accommodation is not left in a reasonably tidy condition.
8. Smoking policy
Please note we operate a strict non-smoking policy (including e-cigarettes).
All traces of smoking must be removed from decking/grounds etc by the hirer by the end of their occupancy. A charge of £200 will be made for deep cleaning of the property if any guest smoke in the property.
9. Right of Entry
We shall be allowed reasonable right of entry to the property at all reasonable times for purposes of inspection or to carry out any necessary repairs or maintenance whether or not you are present.
10. Taking Care of the Property
You are responsible for the property and are expected to take all reasonable care of its furniture, pictures, fittings and effects, in, on, around and attached to the property. You must leave them in the same state of repair and in the same clean and tidy condition at the end of the rental period as at the beginning. You undertake the leave the property secure if left unoccupied during the period of let. You must not use the property for any dangerous, offensive, noxious, noisy, immoral activities or carry out any act that may be a nuisance or annoyance to the owner or other neighbouring properties.
Recycling facilities and rubbish bins are located within bin compounds around the Holiday Park. Please dispose of rubbish in the appropriate bins and do not leave rubbish outside of your accommodation.
11. Damages & Breakages
You are legally bound to reimburse us for replacement, repair or extra cleaning costs on demand (although we would not charge you for the odd glass or plate). If you lose a key(s) we will arrange replacement upon you paying for the cutting of a new one.
We ask that you report any accidental breakages to us immediately and where deemed necessary, leave payment for replacement/repairs prior to departure.
We aim to ensure that the property you have hired is maintained to a high standard and as such we ask that all faults or failure with any equipment within the holiday home be reported immediately in order that we can take steps to remedy any issues as prudently as possible.
We cannot be held liable for a breakdown of any facility which is beyond our reasonable control (e.g. breakdown or failure of any electrical supply or equipment or plumbing) or from any misuse or negligence of you using the equipment.
Sorry but no pets are allowed.
13. Internet access
Internet access is provided for guests’ use. The current password will be contained in the guest help manual within the property. You agree to reasonable and lawful usage of this service.
14. Refundable Security Deposit
We reserve the right to ask for payment of a security deposit with the balance of rental. This is held in case of unreported breakages, loss or damage to items within the property together with any excess cleaning or refuse disposal required after occupancy.
Information you have given us in connection with your booking is treated in accordance with the General Data Protection Regulations (GDPR) currently in effect. We do not share your details with anyone and will delete any information we hold about you which is of a private nature per GDPR once your booking is completed. We will only retain such details as are required of us under regulation, current legislation or where we have a legitimate interest and need to do so.
As far as the law allows, we and any of our representatives shall not be liable to you or your party for loss, damage or injury to you or any of your party or your/their property or vehicles as a consequence of this agreement or the occupancy following thereon. You indemnify us against loss, damage or injury sustained to the property or any persons as a result of any breach of these conditions or arising from the fault of you or any member of your party.
17. Accuracy of Details
The letting details including any brochures, website content or similar are as accurate as possible but cannot be warranted, nor do the descriptions form any contract. Whilst every effort is made to ensure accuracy of property descriptions and images, the facilities and services may alter. We reserve the right to alter or improve any of the subjects without notice.
18. Legally Binding
The owner reserves the right to demand the immediate removal of any persons found not complying with these conditions, or for any conduct detrimental to the property. It is agreed that by making a booking you agree to all of these terms and conditions.
In the event that any individual term or clause stated in these Terms and Conditions of Let becomes non-permissible by law, the remainder of the agreement shall remain valid.
19. Health and Safety including Park Rules
In the welcome folder of your holiday accommodation, you will find a copy of instruction manuals for appliances and please familiarise yourself with the Health and Safety notices including Fire notices with the property.
A copy of the General Park Rules is available on site but these can vary because Abbeyford Leisure, who operate St. Andrews Holiday Park, reserve the right to make additions or deletions to the Park Rules from time to time as it considers necessary for the general safety or proper and efficient management of the holiday park.
It is the aim of the park managers to provide services and products which enable all guests within the park to enjoy holidays in a safe, secure and enjoyable environment.
The prevailing Park Rules have been produced to achieve this aim, and should be observed whilst enjoying your holiday as follows:
1. Soft ball games only are permitted to be played on the Park, but please respect neighbouring accommodation. If flying a kite, please stay well clear of overhead power cables.
2. Motor vehicles should not exceed the speed limit and should observe any one-way system. The Highway Code is applicable to the Park. No motorised vehicles prohibited for use on a public road or radio/ wirelessly controlled airborne items are allowed on the park without the permission of the Park General Manager.
3. All persons using the entertainment complex must honour the Club Rules which are clearly displayed within the Club.
4. Recycling facilities and rubbish bins are located within bin compounds around the Park. Please dispose of rubbish in the appropriate bins and do not leave rubbish outside of your accommodation.
5. With respect for your neighbours and other guests on the Park noise is to be kept to a minimum, respectful level, especially late at night by all occupants of your accommodation.
6. Antisocial behaviour towards members of staff, guests, or fellow Owners on the Park is strictly unacceptable.
7. Barbeques are not permitted.
8. Parents and guardians are responsible for their children at all times on Park and should ensure that their children behave responsibly, and are appropriately supervised, especially when enjoying the Park’s facilities.
9. No objects that may cause offence or bodily harm are permitted for use or containment on the Park.
We are sure that you will have a very enjoyable holiday with us. Nevertheless, should you any have cause for complaint, please advise us immediately so we can try and resolve the problem, as it is difficult to investigate complaints of any nature once a client has returned home.
